The legislative measure explicitly states that SBF should not receive a presidential pardon or commutation under any circumstances.
The resolution argues that granting clemency would 'wipe out his conviction, weaken deterrence, and send a grave signal that large-scale financial fraudsters can evade permanent accountability.' Although the U.S. President's pardon power is constitutionally granted, this bipartisan effort highlights significant political resistance. SBF, who was convicted in November 2023 on seven felony charges related to the misuse of FTX user funds and sentenced to 25 years in prison in 2024, had previously applied for a pardon. With the U.S. Federal Appeals Court upholding his conviction last week, a presidential pardon remains one of his few remaining legal options.
