The SEC and plaintiff have requested the dismissal of the case in the U.S. District Court for the District of Columbia, with the agency committing to submit remaining relevant documents and cover legal fees.

The lawsuit, initiated in June 2024 by an agency commissioned by Coinbase, sought materials on the regulatory investigation of Ethereum, including files on Zachary Coburn and Enigma MPC, as well as records concerning the transition from proof-of-work to proof-of-stake. Previous court orders mandated the release of internal communications involving former Chairman Gary Gensler, following revelations that the SEC had deleted text messages from Gensler and 21 senior officials.
