But this is important, as established federal authority is a matter for Congress and SCOTUS.

Just like we don’t want Texas to get to decide if HHS or FDA policy on abortion pills is legal in the state.

You cannot cede federal authority even on issues you don’t agree with.

It is an all or nothing precedent.

If New York thinks the CFTC is wrong, they must deal with it in the Supreme Court and nowhere else.
