Something else that stands out in the self-custody section is the proposal’s apparent focus on bankruptcy protections. It would require RIAs to have a written agreement with clients stating that crypto assets held in the adviser’s self-custody will be treated as financial assets under Article 8 of the Uniform Commercial Code. That may be intended to reduce the risk that clients lose their crypto if an adviser becomes insolvent — a concern the Clarity Act also tried to address.
