You may be taking a false sense of comfort by saying SCOTUS put a stop to this today. In reality there is a large, entrenched component of the judiciary that is unapologetically activist and anti-nation, in the sense that they view American citizenship as no more than a fluke, American social success as wholly unrelated to the composition of its citizenry, and view themselves as having no duty to that citizenry but instead dedicate themselves to the welfare of foreigners, i.e. preventing at all costs the removal of aliens from US soil regardless of circumstance or (as seen here) preventing the effective policing of the nation's borders. This cohort is solidly entrenched in the western courts, which are those that oversee the majority of immigration-related cases, and these courts have shown themselves more than willing to contravene SCOTUS precedent using the excuse of "confusion" regardless of the clarity of the relevant SCOTUS rulings. The mechanism you outline here - lower courts issuing unconstitutional and anti-national rulings and undermining the national fabric for decades at a time - will continue to operate because SCOTUS as a single entity does not have the bandwidth, and seems to lack the mechanism, to properly quell what amounts to judicial rebellion by lower-court justices.

It doesn’t matter. You don’t have to deal with terrible drivers, drivers talking on the phone, drivers who don’t speak English, drivers suddenly deciding that they don’t want your ride and refusing to pick you up until you cancel and get charged $10, driver listening to terrible music, driver giving you a poor rating because you laughed the wrong way at his joke that you didn’t wanna hear in the first place, driver remembering your address after driving you to the airport and returning to rob your house, and it’s inherently cheaper because you don’t have to tip. If you’re a woman, you don’t have to worry about getting raped or assaulted by your driver. Self driving cars drive perfectly in 99.99% plus of scenarios, including many that a human driver would struggle with. Self driving taxis are an inevitable future, and it doesn’t matter if New Yorkers delay the arrival of that future in NYC. It will eventually arrive anyway.
